In Canada, mischief is a criminal offence that refers to the willful or reckless destruction of another person's property, or the interference with another person's property. Mischief is often seen as the charge laid which follows some act of vandalism to property.  Depending on the damage, the charge of Mischief Under $5000, or Mischief Over $5000 will be laid.


Under the Criminal Code of Canada, mischief is found in Section 430 (1) states "Every one commits mischief who wilfully  

  • (a) destroys or damages property;  
  • (b) renders property dangerous, useless, inoperative or ineffective;  
  • (c) obstructs, interrupts or interferes with the lawful use, enjoyment or operation of property; or  
  • (d) obstructs, interrupts or interferes with any person in the lawful use, enjoyment or operation of property. Mischief relating to religious property, educational institutions, etc."


Subsection (4.1) states that "Everyone who commits mischief in relation to property described in any of paragraphs (4.101)(a) to (d), if the commission of the mischief is motivated by bias, prejudice or hate based on colour, race, religion, national or ethnic origin, age, sex, sexual orientation, gender identity or expression or mental or physical disability,  (a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years; or  (b) is guilty of an offence punishable on summary conviction."

In Canada, mischief is a hybrid offence.  What this means is that the Crown can choose to prosecute you by indictment or summary conviction.  In case of an indictment, if the value of the assets that you destroyed exceeds $5000.00, you could face as many as ten years in prison. For property damage less than $5000.00, you could face imprisonment not exceeding two years.  In the case of summary conviction, you could face up to 6 months in prison.
